These End User Terms (“Terms”) form a binding agreement between you and Altra Health Limited trading as Altra, a company registered in Ireland (“Altra”, “we”, “us”), and govern your use of the Altra platform (the “Services”).
Acceptance. You accept these Terms by ticking the acceptance box when you create your account or first access the Services. We record the version of the Terms you accepted and the date of acceptance. If you do not accept these Terms, you may not use the Services.
These Terms apply to all individual users, including staff, family members and any other authorised users accessing the platform through a care provider that uses Altra.
1. About Altra
Altra provides a software platform that enables communication, engagement and content sharing within care environments. The platform may include messaging, activity updates, media sharing and other features.
Altra is a technology provider only. Altra does not provide care services, medical advice or safeguarding services.
2. Eligibility and Access
You may only use the Services if you have been authorised by a care provider that uses Altra, and if you are at least 18 years old or the age of majority in your country of residence.
You must ensure that all information you provide is accurate and kept up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account. You must not share your account with others or allow unauthorised access to the platform.
3. Acceptable Use
You agree to use the Services in a lawful and respectful manner. You must not:
• Upload or share content that is unlawful, abusive, harmful, defamatory, obscene or offensive;
• Share content that infringes the rights of others, including privacy and intellectual property rights;
• Upload images, videos or information about individuals without appropriate consent;
• Upload medical, clinical or health records, or any other special category data, as the platform is not intended for such data;
• Use the platform to harass, threaten or harm others;
• Attempt to access accounts, systems or data that you are not authorised to access;
• Interfere with or disrupt the operation of the Services.
Altra reserves the right to suspend or remove access where these Terms are breached.
4. User Content
You may upload or share content through the platform, including messages, photos, videos and other materials. You remain responsible for all content you upload, and you must ensure that you have the right to share it and that it does not violate any laws or the rights of others.
By uploading content, you grant Altra a limited, non-exclusive licence to host, store, display and transmit that content solely for the purpose of operating, maintaining and providing the Services on behalf of your care provider. This licence ends when the content is deleted, except that residual copies may remain in backups for a limited period. Altra does not use your content for its own purposes.
Altra does not routinely monitor user content but reserves the right to remove content that violates these Terms or is otherwise inappropriate.
5. Privacy and Data Protection
The care provider that has given you access to the platform is the data controller and determines how your personal data is used. Altra acts as the care provider’s data processor and processes your personal data only on the care provider’s documented instructions, under a data processing agreement.
Information about how your personal data is used, including the source of your data and your rights, is set out in the privacy notice provided by your care provider. If you have questions about how your data is used, please contact the relevant care provider.
Where Altra acts as a controller for limited processing such as operating and securing the platform itself, Altra’s own Privacy Policy applies.
6. Health and Content Disclaimer
The platform may include wellbeing or activity-related content. This content is provided for general informational purposes only. Altra does not provide medical advice. You should consult a qualified professional before undertaking any physical activity or relying on any information provided through the platform. You are responsible for assessing your own suitability to participate in any activities.
7. AI and Automated Features
The platform may include features that generate content using automated systems. Such content may be inaccurate or incomplete, and you should not rely on it without review. Altra accepts no responsibility for decisions made based on such content.
8. Availability of the Service
Altra aims to provide a reliable service but does not guarantee that the platform will always be available or error free. Access may be interrupted for maintenance, updates or factors outside Altra’s control.
9. Intellectual Property
All rights in the platform and its content, excluding user content, are owned by Altra or its licensors. You may not copy, modify or distribute any part of the platform except as permitted by law.
10. Safeguarding and Responsibility
The platform is not a safeguarding or emergency response system. Altra does not monitor user activity for safeguarding purposes and does not intervene in care situations. If you have any safeguarding concerns, you must contact the relevant care provider or the appropriate authority directly.
11. Limitation of Liability
To the extent permitted by law, Altra is not liable for any indirect or consequential loss arising from your use of the platform. Altra is not responsible for:
• Content uploaded by users;
• Actions or decisions taken by care providers;
• Any reliance on content or communications within the platform.
Nothing in these Terms excludes or limits liability where it cannot be excluded or limited under applicable law.
12. Suspension and Termination
Altra may suspend or terminate your access to the platform if you breach these Terms or if your access is withdrawn by the care provider that authorised you. Your access will also end if the care provider’s agreement with Altra terminates.
13. Changes to These Terms
Altra may update these Terms from time to time. For material changes, we will notify you and may ask you to accept the updated Terms before you continue to use the Services. Continued use of the platform after non-material changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland and are subject to the jurisdiction of the Irish courts.
Consumers. If you use the Services as a consumer, you continue to benefit from the mandatory protections of the law of your country of residence, and nothing in these Terms deprives you of that protection. Where required by law, you may also bring proceedings in the courts of your country of residence.
15. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect. These Terms are between you and Altra and are separate from any agreement between you and your care provider. Altra’s failure to enforce any right does not waive that right.
